1. What is REACH?

REACH is an abbreviation for "Registration, Evaluation, Authorization and Restriction of Chemicals"

The purpose of this regulation is to ensure a high level of protection of human health and the environment as well as the free circulation of substances on the internal market while enhancing competitiveness and innovation.

REACH parts from the premise that manufacturers, importers and downstream users must make sure that they only manufacture, place on the market or use substances that do not harm human health or the environment. All its provisions are based on the precautionary principle.

Substance registration is mandatory for anyone who produces or imports more than one metric ton of a substance per year.

Unregistered substances may not be used or marketed.

Substances only have to be authorized or even restricted, if they are "of very high concern".

2. Does REACH apply to you?

REACH applies to manufacturers, importers and users of chemicals

Substances must be registered by whoever places them on the market, i.e., the manufacturers or importers.

Companies that buy substances in the European market are called "downstream users".

A phased approach with different deadlines has been developed in order to facilitate registration. Some substances have been exempted from registration for example oxygen, hydrogen and other, as not dangerous known natural substances or other substances, which are regulated other wise like pharmaceuticals, biocides or cosmetics.

Manufacturers and importers

Must register all substances which they manufacture or import in quantities of more than one metric ton per year.

Unregistered substances may not be used or marketed. The registration should be accompanied by a technical dossier (expanded MSDS) and - depending on the substance or the amount - a chemical safety report that includes all the identified uses that the manufacturer is aware of.

Downstream users

May also be required to register substances if they not only purchase but also synthesize or import substances.

In addition, users must check whether their individual use of the substance has been included in the manufacturer's chemical safety report.

If not, they can either ask the manufacturer to include this use in its chemical safety report or prepare their own chemical safety report.
