Psychological stress at the workplace - Your questions about mental health

The German Civil Code (BGB) requires employers (including in § 241(2) and § 618) to take into account the rights and health of their employees and to implement appropriate protective measures.

According to the Occupational Safety and Health Act (ArbSchG), employers are obligated to address the mental health of their employees. Section 5 of the ArbSchG requires them to identify and assess psychological stress in the workplace as part of a risk assessment. The goal is to prevent or minimize risks to mental health.

As part of Workplace Health Management (BGM), a risk assessment is required by law as part of occupational safety and health protection. The obligation to conduct a risk assessment applies regardless of the size of the company. Its focus is on the design of working conditions, not on the mental state of employees. The results of the risk assessment must be documented in writing.
