When do you need a waste management officer?

The Waste Management Officer Regulation (AbfBeauftrV), initially passed in 1971 and last amended in June 2017, imposes a duty to appoint a waste management officer, along with the Second Regulation on the Further Development of Waste Law Monitoring for Companies (“ Zweite Verordnung zur Fortentwicklung der abfallrechtlichen Überwachung”). Section 60 of the German Closed Substance Cycle and Waste Management Act (KrWG) provides a further legal basis for the waste management officer function.

According to § 2 of the Waste Management Officer Regulation, operators of facilities permittable under the 4th Federal Immission Control Regulation (BImSchV) are required to appoint a waste management officer if they generate more than 100 metric tons of hazardous waste or more than 2,000 metric tons of non-hazardous waste per calendar year.
