The European Packaging Regulation has been in effect since August 12, 2026—What Companies Need to Know Now
The Packaging and Packaging Waste Regulation (PPWR) entered into force at the beginning of 2025. As of August 12, 2026, the first binding requirements of the new European Packaging Regulation are now in effect. The regulation aims to reduce packaging waste, strengthen the circular economy, and improve the sustainability of packaging in the European Union. Among other factors, this is driven by rising packaging volumes and the fact that many EU member states have failed to meet their previous recycling targets.
What you should know
As an EU regulation that is directly applicable, the PPWR establishes, for the first time, a uniform Europe-wide legal framework for packaging. It applies to all packaging, regardless of material, distribution channel, or any potential obligation to participate in a recycling system, and applies to all economic operators along the supply chain. No distinction is made between B2B and B2C transactions.
Beware of stumbling blocks
As of August 12, 2026, companies must meet the first specific requirements, including guidelines on substance concentration limits, the conduct of conformity assessments, and the preparation of an EU declaration of conformity. Additional requirements will be gradually specified in the coming years through further legislative acts and technical guidelines.
Important Deadlines at a Glance
- August 12, 2026: Substance limits, conformity assessment, and the EU Declaration of Conformity must be complied with
- No earlier than August 12, 2028: Expected start of extensive labeling requirements (subject to implementing legislation)
- January 1, 2030: Requirements regarding recyclability, recycled content, packaging minimization, and reuse will gradually take effect
- January 1, 2035: Packaging must be recyclable on an industrial scale. It must be possible to collect and sort it without compromising the recyclability of other materials.
- January 1, 2038: Only recyclability classes A and B will be permitted
Note: The PPWR is still being finalized. Many requirements will only be defined in greater detail through future delegated acts, implementing acts, and technical standards.
Who is affected by the PPWR?
The PPWR applies to all economic operators along the packaging supply chain. This includes producers, importers, distributors, manufacturers, and suppliers of packaging or packaged products. It does not matter whether products are sold to businesses or end consumers, as the regulation expressly does not distinguish between B2B and B2C transactions.
What types of packaging are covered by the PPWR?
The scope of the PPWR is very broad and covers all types of packaging, regardless of the material used. This includes sales packaging that directly encloses the product, outer packaging used to bundle multiple sales units, transport packaging for storage and shipping, and packaging for e-commerce. In addition, other types of packaging—such as reusable, service, primary production, or compostable packaging—are also covered by the regulation.
What obligations have been in effect since August 12, 2026?
As of August 12, 2026, packaging must meet certain material requirements. These include compliance with limit values for heavy metals and PFAS limit values for food packaging. At the same time, companies are required to conduct a conformity assessment for their packaging and issue an EU Declaration of Conformity. Packaging has thus become a standalone compliance requirement and must demonstrably meet the applicable PPWR requirements.
What documents do companies need?
To demonstrate PPWR compliance, companies must prepare and maintain technical documentation. This documentation is based on calculations, tests, specifications, and other evidence demonstrating that the relevant requirements are met. An EU Declaration of Conformity must also be prepared based on the conformity assessment. The documentation must be continuously updated and kept available beyond the required retention periods.
What future challenges will companies face?
In the coming years, additional key requirements of the PPWR will be gradually specified and made mandatory. These include guidelines on the recyclability of packaging, mandatory minimum recycled content requirements for plastic packaging, requirements for reusable packaging, and regulations to minimize packaging volume and empty space. In addition, new labeling requirements will be introduced, such as those regarding material composition, the recycled content, or the reusability of packaging. Many of these requirements are still contingent on pending delegated acts, implementing acts, and technical standards.
Recent Developments
The PPWR will be further specified in the coming years through additional secondary legislation and technical specifications. Among other things, the requirements for the recyclability of packaging and the minimum recycled content in plastic packaging will be further elaborated. The detailed labeling requirements under Article 12 have not yet been fully established either, as the corresponding implementing act is still pending. In addition, the requirements for reusable packaging and the associated reuse systems will be clarified through further legislative acts.
